1. Хто надає сервіси

Сервіси надає фізична особа-підприємець Запша Владислав Олександрович, далі — «ми». Адреса: Україна, м. Одеса, просп. Полковника Гуляєва, 107/1, ТРЦ «Маяк А1», офіс 908. Користуючись сайтом або будь-яким із сервісів, ви погоджуєтеся з цими Умовами та Політикою конфіденційності.

2. Що таке сервіси

Instagram AI Agent — Telegram-бот, що генерує тексти й зображення за допомогою штучного інтелекту, публікує дописи та відео в підключені акаунти (Instagram, Facebook, TikTok, YouTube, Threads, LinkedIn, X, Pinterest), показує статистику і запускає рекламу Meta Ads з рекламного кабінету користувача. Кожна публікація і кампанія виконується лише після вашого підтвердження кнопкою.
DAIMON CRM — платформа, на якій бізнес (студія, клуб, салон, рієлтор) створює власного Telegram-бота для запису клієнтів, абонементів, оплат, нагадувань і звітів.
AI-менеджер переписок і розробка під ключ — рішення, які ми впроваджуємо для конкретного бізнесу за окремим договором; ці Умови застосовуються до них у частині, що не суперечить договору.

3. Хто може користуватися

Сервісами можуть користуватися повнолітні особи та бізнеси, які мають право розпоряджатися акаунтами й даними, що підключаються. Підключаючи акаунт або створюючи бота студії, ви підтверджуєте, що є його власником або маєте дозвіл власника.

4. Підключення соцмереж

Акаунти підключаються виключно через офіційні процедури авторизації (OAuth) кожної платформи. Ми не просимо і не зберігаємо паролі. Токени доступу зберігаються в зашифрованому вигляді та використовуються лише для дій, які ви ініціюєте. Ви можете будь-коли відʼєднати мережу в боті або відкликати доступ у налаштуваннях самої платформи.

5. Правила платформ

Ви зобовʼязуєтесь дотримуватися правил кожної платформи, зокрема Умов Meta, Умов TikTok, Умов YouTube, Політики конфіденційності Google та Умов Telegram. Сервіс використовує YouTube API Services. Заборонено публікувати через сервіси контент, що порушує закон або правила платформ, а також використовувати сервіси для спаму.

6. Контент і відповідальність

Ви відповідаєте за контент, який публікуєте, включно з текстами та зображеннями, згенерованими штучним інтелектом на ваш запит — перед публікацією ви переглядаєте й підтверджуєте їх. Ми не гарантуємо охоплення, продажі чи результати реклами. Платформи можуть обмежувати видимість публікацій (наприклад, до проходження застосунком аудиту) — бот показує фактичний статус публікації.

7. DAIMON CRM: студія та її клієнти

Студія, яка створила бота, є володільцем даних своїх клієнтів і відповідає за законність їх збору та за інформування клієнтів. Ми обробляємо ці дані за дорученням студії як оператор платформи.
Студія відповідає за свої ціни, розклад, тексти в боті та за виконання зобовʼязань перед своїми клієнтами. Ми не є стороною відносин між студією та її клієнтом.
Новій студії надається безкоштовний період; далі платформа працює за тарифом, опублікованим у боті. Після закінчення оплаченого періоду бот переходить у режим перегляду; дані студії видаляються за правилами платформи, про що студію попереджають заздалегідь.
Ми можемо обмежити студію, яка порушує закон, ці Умови або правила Telegram.

8. Оплата

Instagram AI Agent: базові можливості безкоштовні з лімітами, розширений тариф оплачується через Telegram Stars; повернення — за правилами Telegram Stars. DAIMON CRM: безкоштовний період, далі тариф, зазначений у боті; оплата через платіжного провайдера або на рахунок. Розробка під ключ і AI-менеджер — ціна, строки й порядок оплати фіксуються письмово до старту. Питання оплати — на support@daimon-ai.com або в Telegram.

9. Припинення

Ви можете припинити користування будь-коли: відʼєднати мережі, зупинити бота студії та попросити видалити дані (див. інструкцію). Ми можемо обмежити доступ користувачам, які порушують ці Умови або правила платформ.

10. Обмеження відповідальності

Сервіси надаються «як є». Ми докладаємо розумних зусиль для їхньої безперервної роботи, але не відповідаємо за збої платформ (Meta, Telegram, платіжних провайдерів), за упущену вигоду та за рішення, ухвалені на підставі згенерованого контенту чи статистики. Наша відповідальність перед вами обмежена сумою, сплаченою вами за останні три місяці користування відповідним сервісом.

11. Зміни умов

Ми можемо оновлювати ці Умови; актуальна версія завжди доступна за цією адресою із зазначенням дати. Продовження користування після оновлення означає згоду з новою редакцією.

Terms of Service

1. Who provides the services

The services are provided by sole proprietor Vladyslav Zapsha, “we”. Address: Office 908, Mayak A1 mall, 107/1 Polkovnyka Huliaieva Ave., Odesa, Ukraine. Contact: e-mail support@daimon-ai.com, Telegram @Daimon_AI_Studio, phone +380 73 722 40 82. By using the website or any of the services you agree to these Terms and the Privacy Policy.

2. The services

Instagram AI Agent — a Telegram bot that generates text and images with AI, publishes posts and videos to connected accounts (Instagram, Facebook, TikTok, YouTube, Threads, LinkedIn, X, Pinterest), shows insights and runs Meta Ads campaigns from the user's own ad account. Every post and campaign runs only after your explicit confirmation.
DAIMON CRM — a platform on which a business (studio, club, salon, realtor) creates its own Telegram bot for customer bookings, passes, payments, reminders and reports.
AI Chat Manager and custom development — solutions we implement for a specific business under a separate contract; these Terms apply to them insofar as they do not conflict with that contract.

3. Eligibility

The services are for adults and businesses entitled to manage the accounts and data they connect. By connecting an account or creating a studio bot you confirm that you own it or have the owner's permission.

4. Connecting social networks

Accounts are connected exclusively through each platform's official authorization flow (OAuth). We never ask for or store passwords. Access tokens are stored encrypted and used only for actions you initiate. You can disconnect a network in the bot or revoke access in the platform's settings at any time.

5. Platform rules

You agree to comply with the rules of each platform, including the Meta Terms, TikTok Terms, YouTube Terms of Service, Google Privacy Policy and Telegram Terms. The Service uses YouTube API Services. Publishing unlawful content, content that violates platform rules, or using the services for spam is prohibited.

6. Content and liability

You are responsible for the content you publish, including AI-generated text and images produced at your request — you review and confirm them before publishing. We do not guarantee reach, sales or advertising results. Platforms may limit the visibility of posts (for example until an app passes their review); the bot shows the actual publication status.

7. DAIMON CRM: the studio and its customers

The studio that created a bot is the controller of its customers' data and is responsible for collecting it lawfully and informing its customers. We process these data on the studio's behalf as the platform operator.
The studio is responsible for its prices, schedule, bot texts and for fulfilling its obligations to its customers. We are not a party to the relationship between a studio and its customer.
A new studio gets a free period; afterwards the platform works on the plan published in the bot. When the paid period ends the bot switches to read-only mode; the studio's data is deleted under the platform rules, with advance notice to the studio.
We may restrict a studio that violates the law, these Terms or Telegram's rules.

8. Payment

Instagram AI Agent: basic features are free with limits, the paid plan is purchased with Telegram Stars; refunds follow Telegram Stars rules. DAIMON CRM: a free period, then the plan shown in the bot; payment via a payment provider or bank transfer. Custom development and AI Chat Manager: price, deadline and payment schedule are fixed in writing before we start. Payment questions: support@daimon-ai.com or Telegram.

9. Termination

You may stop using the services at any time: disconnect networks, stop the studio bot and request data deletion (see the instructions). We may restrict access for users who violate these Terms or platform rules.

10. Limitation of liability

The services are provided “as is”. We make reasonable efforts to keep them running, but we are not liable for outages of platforms (Meta, Telegram, payment providers), for lost profit, or for decisions made on the basis of generated content or statistics. Our liability to you is limited to the amount you paid for the relevant service in the last three months.

11. Changes

We may update these Terms; the current version with its date is always available at this address. Continued use after an update means acceptance of the new version.
